As I asserted earlier most people without military training (and some with) will hesitate. So if you’re a women in a mall parking lot and a rapist is out for you a whistle and a can of professional strength pepper spray would be a significantly preferable defense over a handgun.

It is NOT 100% effective in all cases.
While this sounds like the beginning of an urban legend, my boyfriend's best friend's sister-in-law (whom I also happen to know, hence the non-legend status) is a police officer. As part of their training they get tear-gas or whatever it is sprayed into their faces. She and/or her husband (also a copper) didn't have any reaction to it. It happens in between 3-10% of cases. Not a statistic that is particularly comforting when being a woman in a car park at night....

In all seriousness, this isn't the movies. If you are frightened enough to retrieve a weapon, you're not going to go all 'in 'da 'hood about it and waste time posturing. Do or do not, there is no try.

Essentially, you cannot escalate more than one level of violence (excessive force). If they are completely unarmed, your baseball bat is valid, but if they have a knife, you may use a gun if you are in genuine fear of your life or that of your family. You can't shoot the guy for an unarmed raiding of your icebox. One other important distinction, which varies from state to state, is at what point the intrusion implies deadly intent. In Pennsylvania, the assailent must be inside the home. In New Hampshire, the law merely states that the intruder must be within the curtilage.
